Compliance statement
All persons appearing in any visual depiction of actual or simulated sexually explicit conduct made available through LinkPay were over the age of eighteen (18) years at the time the visual image was created. Records required by 18 U.S.C. § 2257 and 28 C.F.R. § 75 for all such depictions are on file with the appropriate Records Custodian.
[Company Legal Name] operates LinkPay as a platform that transmits, stores, hosts, retrieves and formats content uploaded and published by its users. [Company Legal Name] is not a “producer” — primary or secondary, as those terms are defined in 18 U.S.C. § 2257 and 28 C.F.R. § 75 — of any content published by users through the platform. Its activities with respect to that content are limited to transmission, storage, retrieval, hosting and formatting of material published in areas of the platform under the control of the user who published it.
Every person who publishes content through LinkPay must comply with 18 U.S.C. § 2257, § 2257A and 28 C.F.R. § 75. Pursuant to 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c), we reserve the right to remove content we consider unlawful, indecent, obscene, defamatory or otherwise inconsistent with our Terms of Service and Acceptable Use Policy.
Records Custodian
Records required to be maintained by federal law will be made available to authorized inspectors by the Records Custodian at:
[Records Custodian Name]
[Company Legal Name]
Attn: Records Custodian
[registered address]
[2257@linkpay.co]
[⚠ Not yet in force. A named custodian and a real inspection address are required before adult content can lawfully be offered. This must be resolved before launch.]
What sellers must hold
Before publishing any adult content, and at any time we reasonably request it, you must be able to provide, for yourself and for every person appearing in the content:
- a valid government-issued identification document showing legal name and date of birth. For a US citizen or resident, this means a document issued by a US federal, state or local government;
- a list of every other name ever used by that person — maiden name, alias, nickname, stage name or professional name;
- documented consent to being recorded and to the content being sold, recorded in writing;
- the date the content was created.
You must verify the identity and age of everyone depicted before the content is created, not afterwards. This applies equally to content that is generated or altered by artificial intelligence and depicts a real person.
How long you must keep records
If you are a US citizen or resident: you must maintain these records for the duration of your agreement with us and for seven (7) years after it ends, and you must maintain a Records Custodian as defined in the regulations.
If you are outside the United States: you must take the steps required by the law where you live to confirm that no person appearing in your content was under eighteen — or under the higher age at which a person may lawfully appear in adult content in your jurisdiction, where one applies — and keep records of having done so.
If you cannot produce the records
We may request your records at any time. If you cannot produce them, or if you repeatedly breach this notice — including your obligations in respect of other people appearing in your content — we will:
- remove or block the content in question;
- suspend your ability to publish adult content;
- withhold disbursement pending resolution; and
- terminate your account, permanently where the failure concerns the age or consent of a person depicted.
Where we have reason to believe a person depicted was a minor, or did not consent, the content is removed immediately, the account is banned, and the matter is reported to the National Center for Missing & Exploited Children and to law enforcement. There is no warning step for this.
Reporting a concern
If you believe content on LinkPay depicts a minor, or depicts anyone who did not consent, report it immediately to [2257@linkpay.co]. Please describe the content and give us the link — do not download, copy, save or forward it. Handling such material can itself be an offence. See also Content Moderation, Reporting and Removal.
